CA: Notice of California SB 1242 Amendment

Effective Jan. 1, California SB 1242 Amendment stipulates that once an agent places an application with an insurance carrier, if they identify or suspect fraud, the agent must report the information directly to the insurance carrier for investigation.

 

The agent should complete the form and submit it to CALiberty_Investigations@libertymutual.com as soon as possible. The form will require information, including agency name, agent name, customer’s information, policy number & type, claim number (if applicable), details of the concern and any relevant attachments.

Business lines communicable disease exclusion

COVID-19 has brought a host of uncertainties into the small commercial insurance space, among them potential exposures to virus-related liability claims. Of particular concern are future pandemics that could drive outsized losses and undermine our ability to offer profitable small commercial insurance products. Effective Feb. 1, 2021*, when you write new general liability, BOP, simple BOP and umbrella policies in eCLIQ® for certain classes – such as janitorial services, healthcare facilities and personal care services – the system will automatically apply the communicable disease exclusion. Existing policies in the same classes will have the exclusion applied at renewal effective June 1, 2021.

 

Note that underwriters may, at their discretion, attach the exclusion to other classes of business, depending on the exposures presented. They will alert you to this change should they do so. Renewals with the automatically attached exclusion will include a policyholder notice. Have questions about how the exclusion works and which classes it affects? *The communicable disease exclusion is currently active for both new business and renewing general liability, BOP, simple BOP and umbrella policies in all states except HI, IL, NY, TX and WA. We will communicate any changes in filings in these states separately as needed.
